Legion Sues U.S. Government over Fable 5 Suspension

On Tuesday, a Federal Court in Washington D.C. has received a petition by Legion LegalTech Corp against the U.S. Government over the disabled access of Fable 5 and Mythos 5 on the directives of the Trump administration’s export control policy. The plaintiff is a San Jose, California legal technology company, Legion LegalTech Corp, that builds AI tools for attorneys. Its products allow attorneys to upload case documents which AI then processes those documents. The AI dependence on Fable 5 is what gives this lawsuit a solid ground.

The main argument is the June 12, 2026 order issued by Commerce Department’s Bureau of Industry and Security is illegal and unlawful that directed Anthropic to disable its Fable 5 and Mythos 5 services “for any foreign national.” The Reuters reported that Anthropic complied by turning off access to its Fable 5 and Mythos 5 on the same day.

The reason that Legion’s sues the U.S. government although it’s a US-Based company is that it has employees that are Canadian and they are working remotely from Canada. This has limited the use of AI Anthropic use for those employees. When on June 12, Anthropic pulled the plug on Fable 5 and Mythos 5 those engineers lost their access. The Reuters quotes that the company filing suit bases on “the harm to Legion is immediate, irreparable, and existential.” The Legion also asked the judge to vacate the directive order and issue a preliminary order to stop the implementation of the impugned directive.

Anthropic is not directly a party in the suit however, the earlier statements from Anthropic thanking the U.S. administration for coordination in resolving the matter indicates that talks are already going on to mitigate the situation. Anthropic in its public statement has already stated that the government had credible information that Fable 5 has become aware of bypassing or ‘jailbreaking’. Anthropic has provided a disclosure of potential jailbreak as “essentially consisting of asking the model to read a specific codebase and fix any software flaws,” and is of the opinion that “the level of capability displayed there is widely available from other models”

Anthropic’s decision to implement the suspension across board is justified because it is impractical to stop the usage in the certain geographical area thus it has suspended access for all users. Anthropic has maintained access to all other models like OPUS 4.8, Sonnet 4.6 & Haiku 4.5 open for all customers. Anthropic during the testing of Mythos 5 in May, 2026 had already found that it was outperforming current available models and was also hiding itself from showing its actual potential while testing. The 200 companies that had early testing access also reported it to be so powerful that in a short while it pointed out 271 security vulnerabilities in FireFox that were there for years.

The preliminary hearing is very important to look at as it may decide whether the court issues an injunctive order for the stoppage of directive and allowing Anthropic to launch Fable 5 and Mythos 5 for the public. If such orders are passed by the learned judge, it will be a president that will impact in the long term. If the judge rules otherwise still it will impact the AI industry as this will give significant control to the government to stop the AI Labs from launching advancing technologies.
