Musk V. Altman: Elon Musk Says: “OpenAI Was My Idea”

The feud between tech billionaires Elon Musk and Sam Altman takes a dramatic turn as the high-profile legal wrangle over the fate of OpenAI dominates news websites. Musk testified in a court hearing in California this month that OpenAI had been his idea, and accused Altman of violating the founding purpose of the organisation Musk said he had set up OpenAI in 2015 as a non-profit intended simply to ensure that artificial intelligence developed safely and openly for the good of humanity.

But he claimed it had mutated into a corporation all but wholly owned by capitalist concerns, led by Microsoft. Musk, who also testified in the case, said he invested in OpenAI because he believed it would always be transparent and focused only on non-profit aims. In his testimony, Musk said that moving toward commercialization was explicitly against the agreement he had with other co-founders of the company. 

Musk also added it could eventually harm public trust in NGOs if non-profits are structured to become “wealth machines.” The lawsuit names Sam Altman, OpenAI President Greg Brockman, and the relationship between the company and Microsoft as defendants. Musk is asking for several specific changes to be made, including unwinding OpenAI’s shift to a for-profit business and taking Altman out of the company’s leadership. 

There have been reports of damages in the tens of billions of dollars range, but Musk’s legal team stipulated later that he would not personally keep any money if funds are awarded. OpenAI, however, strongly denies Musk’s allegations. 

The company says Musk was on board with the for-profit plan years ago and claims the lawsuit is about competition something that has intensified since he announced his own AI firm, xAI. OpenAI’s attorneys have called it more of a move to hobble a competing AI front-runner.

 The trial also brought to light internal discord within OpenAI. Former executives and board members described disputes over management, transparency, and organizational matters. Testimony from former chief scientist Ilya Sutskever brought added drama, alleging that worries about Altman’s leadership had arisen well before the lawsuit. As the lawsuit progresses, its results have the potential to lead to a total change in artificial intelligence regulation and decide who the final owner of one of the leading companies in AI on Earth will be.
