Musk vs Altman Trial: What is damage at stake in 2026

Elon Musk and Sam Altman are now facing each other in Oakland, California. The Musk vs Altman is a high profile civil trial jury selection started on April 27, 2026 in the case of Elon Musk v. OpenAI, Sam Altman, Greg Brockman, and Microsoft. The case revolves around the broken trust and disloyalty in a business partnership that was promised in 2015 by Sam Altman and Greg Brockman. OpenAI was started in December, 2015 with mutual understanding between Elon and Sam (Nbcnews).

Before starting OpenAI, Sam Altman and Elon Musk were very close friends. They knew each other through Silicon Valley circles, had dinner together and discussed Risks of AI. The reason behind launching OpenAI in December 2015 was their deep concern about the damage of artificial intelligence (AI). Musk understands AI can become a catastrophe created by humans, and he believes if such tools are not handled with care could cause a crisis beyond the control of any single entity.

Allegedly, Sam Altman sent Elon Musk an Email proposing a Not-For-Profit organization which will keep the progress and achievements of AI and its problems open to the public. Altman sent an email to Musk suggesting a with the Subject “Manhattan Project for AI”. The first idea to create OpenAI. Musk appreciated him and supported him strongly for creating OpenAI. Elon donated the largest funding (around $38–45 million) over the year 2015 to mid-2017 for starting OpenAI and became co-chair with Altman.

In the fall of 2017, Musk demanded Full ownership and CEO position. Musk wanted to be in the leadership of OpenAI. Because Musk Thoughts, he spended more then $44 million to the startup. But Altam refused. After that, things started to get complicated (Axios). 

In 2018 Musk Left OpenAI Organization after disagreements. Officially he said the reason for the resignation of OpenAI’s Board was conflict with Tesla. But in reality,Altman’s side says Musk left OpenAI in anger after disagreements to take control.That was the reason for the end of their friendship.

On April 24, 2026, during the hearing of Musk vs Altman the fraud charges were dismissed as withdrawn. Musk withdrew the charges from the suit to streamline the trial. US District Judge Yvonne Gonzalez Rogers accepted the claims of breach of charitable trust and unjust enrichment to proceed to trial. The jury selected for the trial will look into the charges and decide after the evidence whether the defendants are found guilty or innocent. Must has claimed substantial damages reaching hundreds of Billions and removal of Altman and Brockman from their positions in OpenAI. The trial is expected to last roughly one month or so (nytimes).
