Fair Use

4. Affiliate Disclosure

We believe in being upfront about how we make money. TheTweaks participates in affiliate marketing programs — including Amazon Associates — as well as affiliate programs for software tools and other services. What’s in the Newsletter

Our newsletter includes editorial content, advertisements, and — where relevant — affiliate links. Sponsored or commercial content is always labeled so you know what you’re looking at. The editorial content in our newsletter reflects the genuine views of our team, not the preferences of advertisers or sponsors.

Your Email Address

8. Disclaimers

10. Indemnification

If your use of thetweaks.com or your violation of these Terms causes a third-party claim, legal action, or other liability against us, you agree to cover the costs — including legal fees — that result. This includes situations where:

  • You violate these Terms or any applicable law

  • Content you submitted to us turns out to be infringing, defamatory, or otherwise problematic

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without applying conflict-of-law rules that might point elsewhere. If a dispute arises between you and TheTweaks Media LLC in connection with your use of the Site or these Terms, it will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA) — not in court, and not as a class action.

The one exception: either side may seek emergency injunctive or other equitable relief from a court when intellectual property rights are at stake and waiting for arbitration isn’t practical.

By agreeing to these Terms, you’re waiving your right to a jury trial and your right to join a class action lawsuit related to your use of thetweaks.com.

12. Termination

We reserve the right to suspend or terminate your access to thetweaks.com at any time and for any reason — including, but not limited to, a violation of these Terms. We don’t take that step lightly, but we need the ability to protect the integrity of our platform and community.

13. Severability

If a court or arbitrator finds any part of these Terms unenforceable, that provision will be adjusted to the minimum extent necessary to make it work — or removed entirely if adjustment isn’t possible. The rest of the Terms stay in full effect regardless.

14. Entire Agreement

These Terms, read together with our Privacy Policy, Cookie Policy, and any other policies we reference, make up the complete agreement between you and TheTweaks Media LLC when it comes to your use of thetweaks.com. They replace any prior understanding or communications on these topics.
